Waiver

Bulk Emailing & Email Marketing Compliance

Green Bison Digital understands the importance of compliance with all applicable laws and regulations governing email marketing. In the United States, the main law regulating commercial email is the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (CAN-SPAM Act). This law establishes requirements for commercial messages, gives recipients the right to opt-out of receiving future emails, and prohibits deceptive subject lines and header information.

It is the responsibility of any purchaser of leads and user of Green Bison Digital’s services to ensure their email campaigns comply fully with CAN-SPAM and all other relevant statutes. Some key requirements that must be followed include: clearly identifying email messages as advertisements; including a valid physical postal address; and providing a functioning opt-out mechanism, such as an unsubscribe link. Email lists should be verified and maintained to prevent sending to invalid addresses.

Content and recipients should be monitored to avoid possible complaints. In addition to legal compliance, Green Bison Digital recommends following best practices for email marketing. These include obtaining consent from recipients before adding them to lists, sending emails only to those with an existing customer relationship, designing emails with recipient experience in mind, and maintaining an industry-standard spam filter and sender reputation.
